PRIVACY POLICY

YardOps, LLC ("YardOps," "we," "us," or "our") operates the YardOps website, applications, and related services (collectively, the "Services").

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when individuals visit getyardops.com, request information or a demonstration, communicate with us, create or use a YardOps account, or otherwise interact with the Services.

YardOps is primarily a business-to-business platform. In many cases, an individual uses YardOps on behalf of an employer, customer, or other organization. When an organization provides information to YardOps through its account, that organization may control that information and may have its own privacy obligations.

1. INFORMATION WE COLLECT

We may collect the following categories of information.

A. Information You Provide Directly

We collect information that you or your organization voluntarily provide to us, including:

name
business email address
telephone number
company or organization name
job or business contact information
industry
number of yard or storage locations
approximate asset count
current inventory-tracking method
messages, questions, support requests, and other communications
information submitted through a Request Demo form
account and profile information

When you request a demo, we may also collect information about how you reached the request page, such as referring page information and campaign parameters included in the URL.

B. YardOps Account and Platform Information

When an organization uses the YardOps platform, the Services may process information entered, uploaded, generated, or maintained through that organization's account, including:

Asset IDs
serial numbers
asset types
year, make, model, and color
asset status and condition
yard or physical location
latitude and longitude
QR-code identifiers
scan records
movement history
shipment history
notes
photos
dealer information
customer information
sales-related status information
user names and account roles
operational and audit records

Some of this information may constitute personal information if it identifies or relates to an individual.

C. Location Information

Certain YardOps features are designed to record the location of physical assets.

When an authorized user uses a feature that requests device location, YardOps may receive latitude, longitude, yard assignment, timestamp, and related location information from the user's device.

Location information is used to support asset-location, yard-management, mapping, movement-history, and related operational functionality.

YardOps is not represented as a continuous GPS or telematics tracking service.

Users may control device-level location permissions through their browser or device settings, although disabling location access may limit certain YardOps functionality.

D. Technical and Usage Information

When individuals access our website or Services, our systems and service providers may automatically receive technical information such as:

IP address
browser type
device type
operating system
requested pages or application routes
timestamps
diagnostic information
server and application logs
security events
general usage information

We may use this information to operate, secure, troubleshoot, maintain, and improve the Services.

2. CUSTOMER-CONTROLLED INFORMATION

Organizations using YardOps determine much of the information that they enter into the platform.

Where YardOps processes personal information on behalf of a customer organization, the customer is generally responsible for determining why that information is collected and for providing any notices, permissions, or lawful basis required for its collection and use.

If you have a privacy question concerning information that your employer or another YardOps customer entered into the platform, you may need to contact that organization directly.

We will reasonably assist customers with privacy-related requests where appropriate and required by applicable law or contract.

3. HOW WE USE INFORMATION

We may use information to:

provide, operate, maintain, and secure YardOps
create and administer user accounts
authenticate users and control access
provide QR scanning and asset-identification functionality
record and display asset locations
provide yard, map, inventory, movement-history, shipment, and audit functionality
provide customer support
respond to demo requests and other inquiries
communicate about accounts, service activity, security, support, or product changes
personalize or configure the Services for an organization
diagnose technical problems
detect, prevent, and investigate fraud, abuse, security incidents, or unauthorized access
analyze and improve product performance and usability
develop and improve YardOps features
create aggregated or de-identified operational information that does not reasonably identify an individual or customer
enforce our agreements and policies
comply with applicable legal obligations
protect our rights, customers, users, and Services

We do not use customer data to create targeted advertising profiles.

4. DEMO REQUESTS AND BUSINESS COMMUNICATIONS

If you request a YardOps demonstration or contact us regarding the Services, we may use the information you provide to:

respond to your request
learn about your organization's operational needs
prepare a relevant demonstration
communicate about YardOps
follow up regarding potential use of the Services
maintain reasonable business records regarding the inquiry

Operational or account-related communications may be required while an account remains active.

If we later send optional promotional communications, recipients may opt out using the instructions included in those communications or by contacting us.

5. HOW WE DISCLOSE INFORMATION

We do not sell personal information.

We do not share personal information for cross-context behavioral advertising.

We may disclose information in the following circumstances.

A. Service Providers

We use third-party service providers to help operate YardOps.

These providers may perform services such as:

website and application hosting
cloud infrastructure
database services
authentication
email delivery
business email and communications
mapping and geocoding
security
monitoring
technical support

Current service providers may include services such as Vercel, Supabase, Resend, Google Workspace, and mapping or geocoding providers, as applicable.

These providers process information according to their applicable agreements, privacy terms, and the services they provide to us.

B. Customer Organization

If you use YardOps through an employer or other organization, administrators of that organization may be able to access information associated with your use of the organization's YardOps account, subject to the organization's assigned roles and permissions.

C. Legal and Safety Reasons

We may disclose information when we reasonably believe disclosure is necessary to:

comply with applicable law, regulation, legal process, or enforceable governmental request
enforce our agreements or policies
investigate fraud, abuse, or security incidents
protect the rights, property, or safety of YardOps, our customers, our users, or others

D. Business Transactions

If YardOps, LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction, subject to applicable law.

E. With Your Direction or Consent

We may disclose information when you or the applicable customer organization directs us to do so or otherwise provides appropriate consent.

6. COOKIES, BROWSER STORAGE, AND SIMILAR TECHNOLOGIES

The YardOps marketing website does not currently use third-party advertising cookies for behavioral advertising.

The YardOps application may use browser storage, session storage, authentication tokens, or similar technologies that are necessary to:

keep users signed in
maintain security
preserve application state
remember appropriate user or organization settings
provide core product functionality

If we materially change our use of cookies or tracking technologies, we will update this Privacy Policy and provide additional notice or consent mechanisms when required by applicable law.

7. DATA RETENTION

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

provide the Services
maintain customer accounts
preserve appropriate operational and audit history
respond to inquiries
comply with legal obligations
resolve disputes
enforce agreements
maintain security and fraud-prevention records

Customer information may remain available during the life of a customer account and for a reasonable period afterward, subject to applicable agreements, backup practices, legal obligations, and customer requests.

Demo and inquiry information may be retained for a reasonable period to support follow-up and business recordkeeping.

We may retain aggregated or de-identified information that does not reasonably identify an individual or customer.

8. DATA SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

YardOps also relies on reputable infrastructure and service providers that maintain their own security controls.

However, no Internet transmission, storage system, or software service can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

Customers and users are responsible for protecting their account credentials, controlling access to their devices, and promptly notifying us of suspected unauthorized account access.

9. DATA ACCURACY AND CUSTOMER RESPONSIBILITY

Customers and authorized users are responsible for the accuracy and lawfulness of information they submit to YardOps.

Customers should not submit personal information that they do not have authority to collect or process.

Unless specifically agreed to by YardOps in writing, customers should not use YardOps to store highly sensitive personal information such as:

Social Security numbers
financial-account passwords
complete payment-card information
medical or health records
biometric identifiers
government authentication credentials

10. YOUR PRIVACY RIGHTS

Depending on where you live and applicable law, you may have rights concerning personal information about you, including rights to:

request access
request correction
request deletion
obtain a copy of certain information
object to or restrict certain processing
withdraw consent where processing is based on consent
appeal certain privacy-request decisions where applicable
opt out of certain uses or disclosures where required by law

YardOps does not currently sell personal information or use personal information for cross-context behavioral advertising.

If the information at issue is controlled by a YardOps customer, we may direct your request to that customer or work with the customer as appropriate.

11. CHILDREN

YardOps is a business-oriented service and is not intended for children under 18.

We do not knowingly solicit personal information directly from children through the Services.

12. INTERNATIONAL USERS

YardOps is operated from the United States.

Information may be stored or processed in the United States or other locations where our service providers operate.

If you access YardOps from outside the United States, your information may be transferred to and processed in jurisdictions whose data-protection laws differ from those in your location.

Where required, we will use appropriate mechanisms for international transfers of personal information.

13. THIRD-PARTY LINKS AND SERVICES

YardOps may contain links to or interact with third-party websites, applications, mapping services, or other services.

Their privacy practices are governed by their own terms and privacy policies.

We are not responsible for the privacy practices of third parties that we do not control.

14. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy as YardOps evolves or as legal, operational, or technical requirements change.

When we make changes, we will update the "Last Updated" date.

If a change is material, we may provide additional notice through the website, application, email, or another appropriate method where required.
